Distance Sales Agreement
This agreement is made in accordance with the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
ARTICLE 1 – PARTIES
1.1 – SELLER

1.2 – BUYER
The person who places an order through the YAHYAISIKTAS LTD online store. The address and contact details provided at the time of purchase shall be used for all communications and delivery purposes.
ARTICLE 2 – SUBJECT
This agreement sets out the rights and obligations of both parties in connection with the sale and delivery of products ordered online through the YAHYAISIKTAS LTD store, in accordance with UK consumer protection legislation.
ARTICLE 3 – PRODUCT(S) COVERED BY THE AGREEMENT
The type, quantity, brand/model, colour, number of units, sale price, payment method, and all other details as confirmed at the time the order was finalised.
ARTICLE 4 – GENERAL PROVISIONS
4.1 Before placing an order, the BUYER confirms that they have read and understood all pre-contractual information provided on the YAHYAISIKTAS LTD website, including the essential characteristics of the product, the total price inclusive of all applicable taxes, delivery costs, the estimated delivery timeframe, and the SELLER's full trading name, address, and contact details.
4.2 The product shall be delivered to the BUYER or to the person at the address specified by the BUYER within 30 days of the order being placed, unless otherwise agreed. If the SELLER is unable to deliver within this period, the BUYER is entitled to cancel the order and receive a full refund.
4.3 If the product is to be delivered to a person other than the BUYER, the SELLER shall not be held liable for any refusal to accept delivery by that person.
4.4 The SELLER shall not be held liable for delays or failures in delivery caused by the courier, provided the SELLER has dispatched the product in good time. The SELLER will make reasonable efforts to assist the BUYER in resolving any courier-related issues.
4.5 The SELLER may, for legitimate reasons and prior to the expiry of the agreed delivery period, supply an alternative product of equivalent quality and price, provided the BUYER's prior consent is obtained.
4.6 Should the SELLER be unable to fulfil its obligations due to the product becoming unavailable, the SELLER shall notify the BUYER without undue delay and issue a full refund within 14 days.
4.7 Delivery of the product is conditional upon full payment being received. Should payment not be received or be reversed for any reason, the SELLER reserves the right to withhold or recall the order.
4.8 The BUYER confirms that all payment details entered during checkout are accurate. The BUYER accepts responsibility for any charges arising from the use of their chosen payment method.
4.9 Should the SELLER be unable to deliver within the agreed timeframe due to force majeure or exceptional circumstances such as severe weather or significant disruption to transport networks, the SELLER shall notify the BUYER as soon as reasonably practicable. The BUYER may then choose to cancel the order for a full refund, accept a substitute product of equivalent quality and price, or agree to a revised delivery date. Refunds will be issued within 14 days of cancellation.
ARTICLE 5 – RIGHT OF CANCELLATION
In accordance with the Consumer Contracts Regulations 2013, the BUYER has the right to cancel their order within 14 days of receiving the goods, without giving any reason. This is known as the "cooling-off period."
To exercise the right of cancellation, the BUYER must notify the SELLER in writing within 14 days of delivery:

Once the SELLER has been notified of the cancellation, the BUYER must return the goods within 14 days. The cost of return shipping is the responsibility of the BUYER unless the goods are faulty or not as described.
The SELLER will issue a full refund, including the original standard delivery charge, within 14 days of receiving the returned goods or proof of postage, whichever is earlier. Refunds will be made using the same payment method used by the BUYER.
ARTICLE 6 – PRODUCTS EXEMPT FROM THE RIGHT OF CANCELLATION
The following products are not eligible for cancellation or return under the Consumer Contracts Regulations 2013:
- Goods that have been personalised or custom-made to the BUYER's specifications
- Sealed goods that are not suitable for return due to health protection or hygiene reasons, where the seal has been broken after delivery (e.g. underwear, cosmetics, earrings)
- Goods that have been used, damaged, or are no longer in their original condition
- Perishable goods or goods with a short shelf life
ARTICLE 7 – FAULTY OR MISDESCRIBED GOODS
Under the Consumer Rights Act 2015, the BUYER is entitled to the following remedies if goods are found to be faulty, not as described, or not fit for purpose:
- Within 30 days of purchase: the BUYER may reject the goods and receive a full refund.
- Within 6 months of purchase: the BUYER is entitled to a repair or replacement. If repair or replacement is not possible, a full or partial refund will be issued.
- Within 6 years of purchase: the BUYER may still be entitled to a remedy if it can be shown that the fault existed at the time of delivery.

ARTICLE 8 – PAYMENTS AND REFUNDS
All prices displayed on the YAHYAISIKTAS LTD website are inclusive of VAT where applicable. The BUYER will be charged the total amount shown at checkout.
Refunds will be processed within 14 days of the SELLER receiving the returned goods or being notified of cancellation, whichever is applicable. Refunds will be issued via the original payment method.
ARTICLE 9 – DISPUTE RESOLUTION
In the event of a dispute, the BUYER is encouraged to contact YAHYAISIKTAS LTD in the first instance to seek a resolution.
If the dispute cannot be resolved directly, the BUYER may refer the matter to an Alternative Dispute Resolution (ADR) scheme or contact the Citizens Advice consumer helpline for guidance.
This agreement is governed by the laws of England and Wales.
